I-9/Worksite Compliance

Since November 7, 1986, every employer must have an I-9 Employment Eligibility Verification Form completed for every employee which it employs in the United States. There are no exceptions. Employers are required to keep and maintain all I-9s until requested by federal law enforcement or for a period of time after the employee no longer works for the employer.

Immigration and Customs Enforcement (ICE) conducts audits of employers’ I-9 records to ensure the law is complied with. There are two types of violations: technical and substantive. Regardless of which type of violation is identified, each I-9 form can be subject to multiple violations. Violations result in fines the employer pays.
