You should know that it will take several months for USCIS to make a decision given the number of applications.  As of September 30, 2012, there have been almost 200,000 requests filed.

Granting deferred action is highly discretionary.  It is important to compile the most thorough and persuasive request possible.   To do this successfully takes it takes time, effort and a trained immigration lawyer to assist you so you can pursue your goals, whether that’s college, employment or more.

If you have a felony or “serious misdemeanor” (examples:  DUI, weapons charge, domestic violence, assault) in your criminal history, you may take the necessary steps to expunge your record of those convictions and then you may qualify for Deferred Action. Expungement is not  guaranteed nor easy. Clients in this situation should consult with an immigration lawyer to see if this is a problem.
